1. Agreement to these terms
These Terms of Service ("Terms") form an agreement between you and VolNet, an independent project operated from Georgia ("VolNet", "we", "us", or "our"). They govern your use of the VolNet mobile application, website, and related services (the "Service").
By creating an account, clicking acceptance, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not create an account or use the Service.
If you use the Service for an organisation, you represent that you are authorised to bind that organisation to these Terms. In that case, "you" includes that organisation.
2. Eligibility and accounts
You must be at least 18 years old and capable of entering into a binding agreement to use the Service. You must provide accurate, current, and complete information, keep it updated, and keep your credentials confidential. You are responsible for activity under your account.
Volunteer accounts may be invitation-only. Organisation registrations may be subject to review, verification, approval, rejection, suspension, or removal at VolNet’s discretion, subject to applicable law. We may request reasonable information to verify an organisation or an authorised representative.
Do not share an account, create an account using another person’s identity, or attempt to access an account you are not authorised to use.
3. The Service
VolNet provides tools to help volunteers and organisations create profiles, discover and organise events, send and manage invitations, and coordinate volunteering activity. The Service is a coordination platform; it is not an employer, staffing agency, insurer, emergency service, or guarantor of any user, organisation, event, opportunity, or outcome.
We do not conduct background checks unless we expressly state otherwise in writing. You are responsible for using reasonable judgment and appropriate safeguards when interacting with other users or attending an event.
4. Your content and profile information
You retain ownership of content you submit to the Service, including profile information, photographs, organisation details, and event content ("User Content"). You grant VolNet a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt as technically necessary, display, and distribute User Content solely to operate, improve, protect, and provide the Service.
You represent that you have all rights and permissions needed to submit User Content and that it does not violate law or another person’s rights. You are responsible for your User Content and for the consequences of sharing it.
We may remove or limit access to User Content when we reasonably believe it violates these Terms, law, or the safety of users or the Service.
5. Acceptable use
You must not use the Service to:
- break the law or infringe another person’s rights;
- harm, threaten, harass, stalk, discriminate against, exploit, or impersonate another person;
- post unlawful, deceptive, defamatory, hateful, sexually exploitative, or otherwise harmful material;
- solicit money, personal data, or off-platform contact for fraud, scams, or unauthorised commercial purposes;
- upload malware, interfere with the Service, probe for vulnerabilities, scrape data, bypass access controls, or reverse engineer the Service except where law prohibits that restriction;
- collect, disclose, or misuse another user’s personal information;
- use the Service for emergency response or any situation where failure or delay could cause harm; or
- help another person do any of the above.
6. Events, volunteering, and user interactions
Organisations are responsible for the events, opportunities, invitations, descriptions, locations, and communications they create. Volunteers are responsible for deciding whether to accept an invitation, attend an event, or interact with an organisation or another user.
You must comply with applicable law, event rules, venue rules, health and safety requirements, and reasonable directions of organisers. You are responsible for arranging your own transport, insurance, permissions, equipment, and any other requirements unless an organisation expressly agrees otherwise.
To the maximum extent permitted by law, VolNet is not responsible for the actions, omissions, conduct, statements, services, safety, legality, quality, or availability of users, organisations, events, or venues. If you have an immediate safety concern, contact local emergency services.
7. Push notifications
Push notifications are optional. If you choose to enable them, VolNet may send service-related notifications, including event reminders and requests for an organisation to approve an event. You may turn notifications off through the app where available or in your device settings.
Push notifications depend on your device, operating system, network connection, and third-party delivery services. They may be delayed, unavailable, or not delivered. Notifications are a convenience only and do not replace your responsibility to check the Service for event details, updates, deadlines, or communications. Do not rely on notifications for emergency, safety-critical, or time-sensitive matters.
8. Privacy
Our Privacy Policy explains how we process personal information, including information used to deliver optional push notifications. You must use other users’ information only for the purpose for which it was made available through the Service and in accordance with applicable privacy law.
9. Intellectual property
The Service, including its software, design, branding, and other materials supplied by VolNet, is owned by or licensed to VolNet and protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, we reserve all rights.
You may not use VolNet’s name, logo, or branding without prior written permission, except as necessary to identify the Service truthfully.
10. Suspension, deactivation, and termination
You may stop using the Service at any time. You may deactivate your account through the app settings. Deactivation disables access but does not itself delete your information; see the Privacy Policy for deletion requests.
We may suspend, restrict, deactivate, or terminate access where we reasonably believe you breached these Terms, created risk or legal exposure, provided false information, or where required by law. Where appropriate and legally required, we will provide notice and an opportunity to appeal or correct the issue.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnity, and dispute provisions—will survive.
11. Changes to the Service or Terms
We may change, suspend, or discontinue all or part of the Service where reasonably necessary. We may update these Terms from time to time. We will post the updated Terms and change the effective date. If a change is material, we will provide additional notice or request renewed acceptance where required by law. Continued use after the effective date means you accept the updated Terms, unless applicable law requires another method of acceptance.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, VolNet disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.
Nothing in these Terms excludes or limits a warranty, right, or liability that cannot lawfully be excluded or limited, including mandatory consumer protections.
13. Limitation of liability
To the maximum extent permitted by law, VolNet and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunity, arising out of or related to the Service or these Terms.
To the maximum extent permitted by law, VolNet’s total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid VolNet for the Service in the 12 months before the event giving rise to liability or (b) GEL 100.
These limitations do not apply where prohibited by law, including for liability that cannot be excluded for fraud, intentional misconduct, death, or personal injury caused by negligence where applicable law does not permit exclusion.
14. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless VolNet and its affiliates, officers, employees, agents, and licensors from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of Georgia, excluding its conflict-of-laws rules. The courts of Tbilisi, Georgia will have exclusive jurisdiction over disputes, except where mandatory consumer-protection law gives you the right to bring a claim elsewhere.
Before starting formal proceedings, you agree to contact us at [email protected] and try in good faith to resolve the dispute informally for at least 30 days, unless urgent injunctive relief is required.
16. General terms
These Terms and the Privacy Policy are the entire agreement between you and VolNet regarding the Service. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganisation, or sale of assets, subject to applicable law.
